TERMS AND CONDITIONS
I. GENERAL TERMSCommunication will be done either through direct message on Twitter or Instagram, or via email.Visual references are required and preferred in every commission. Detailed textual descriptions are also encouraged. If the client cannot provide any visual reference, the commission will then be treated as a character design commission and will be priced as such.The high resolution image of the final commissioned piece will be sent through email, both in jpg and png format.II. PAYMENTFor foreign/international clients, all payments are to be transacted in USD. Payments can either be made in full up front before I begin to work on the commission, or half (50%) of the amount before I work and then the other half (50%) is to be paid when I'm done with the commission and before I send in the final work.All foreign/international payments are to be made through PayPal only. A PayPal invoice of your commission order will be sent to your PayPal email for payment. An alternative method is paying through a PayPal.me link.For local clients, payment transactions are to be made through Gcash only. I can also prepare and send an invoice upon request.III. COMMISSION UPDATESCommissions will be placed into an ordered queue, with the first commissions to be accepted as the first to be worked on. It may take me as soon as three days, to as long as three weeks or more depending on my queue, my schedule, and the complexity of the commissioned piece.If your commission has a specific deadline, then this must be discussed prior to paying for your commission, as there is an additional charge for rushed orders.
You will receive updates on the state of your piece when stages such as sketch, line art, base colors and rendering are complete. You may request for updates whenever you want, but please be patient as it may take me a while to respond to messages because of various circumstances, for example when I'm asleep and such.IV. FEEDBACK AND CUSTOMER SATISFACTIONIn every commission I will strive to work to the best of my knowledge and skills. Transparency with my clients is also important and I make sure to disclose necessary information about the process and state of their commission.The progress updates will allow for some revisions to be made, if requested:During the sketch phase, minor revisions are all free and you may request up to 3 free major revisions, however with the fourth and beyond will incur a revision fee. A complete do-over of the whole sketch I provide will incur a more substantial fee, which may vary depending on the complexity of the piece.During the coloring and rendering phase, any revision that requires me to completely redraw parts of the work will incur a revision fee. Color changes and minor adjustments will be free.V. COPYRIGHT AND USAGEI, Emethyst, hold all rights to the commissioned work itself; meaning that I, as the copyright holder, am allowed to:- Use the work in public spaces for the purpose of self-promotion.
- Post the work on public galleries and social media sites.
- Claim ownership of the work itself.
- Include the work in art books or packs that may be sold for profit.
- Use the work for making merch such as prints, stickers, etc, only if the commissioned work is fanart.This doesn't apply for commissons depicting original characters or real people.You, the client, are allowed to:
- Print and display the work for personal use only, unless contractually agreed otherwise.
- Claim rights to the character depicted in the work, but not the work itself.
- Use the work for self-promotion, to post on public spaces as they desire, but only with proper credit given to the original artist (Emethyst).Breaking these terms of service will result in your personal use license of the work to be revoked, and possible blacklisting from further service.Examples of copyright infringement are as follows:
- Reproducing and using the copyrighted work for commercial purposes without a commercial license.
- Wrongfully taking credit for the creation of the work itself.
- Removing any watermarks/signatures from the work.
- Creating unauthorized edits of the work.Commercial licenses may be provided for a one-time fee of roughly 150% of the original commission cost (so a 100 USD commission with a commercial license will cost an additional 150 USD, rendering the total amount due to 250 USD). This will allow you to create merchandise, prints, and other materials out of the work to sell at a profit, for use on books, covers, models, etc, and to alter and edit it for your commercial/promotional needs as required.Please note, this does NOT allow you to claim credit for the original work, you will still be required to credit the original artist (Emethyst), even if it has been altered or edited in some way.Additionally, all of my works and art, commissioned or otherwise, are expressly forbidden from being minted as NFTs (Non-Fungible Tokens) or other such digital commodities on cryptocurrency blockchains. My works and art are also expressly forbidden from being used to train AI (Artificial Intelligence) or create AI generated images/artworks. A commercial-use license does not include the rights to do so.VI. CANCELLATIONS AND REFUNDSPlease note that I, the artist, retain the right to cancel and refund the commission at any point in time for one reason or another.You, the client, do NOT have the ability to cancel or request a full refund once you have agreed to these conditions and paid for the piece.If the commission has not yet been completed after more than three month’s time, you may request a refund on that basis, but ONLY if the commissioned piece has not yet been completed. If a commission’s sketch phase has been approved and set up for painting, then you will only receive a 50% refund. If the coloring phase has been approved, you will receive a 30% refund. Refunds will not be given for any reason once a commissioned piece is considered “finished”, meaning, the rendering has been completed.Any refunds will be processed when it is financially viable for me to do so; even if I approve a request for a refund, please be patient if it takes some time.Attempted chargebacks will mean you lose the right to your commissioned work, and said work will be repurposed for another commission or personal piece. The chargeback will be disputed with PayPal, and you will be blacklisted from future commission work from me. I may also, at my discretion, opt to warn other artists and encourage them not to take further commission work from you.VII. OTHERSAll prices are subject to change at any time and are not negotiable to go lower. These prices are only referential and the final price will depend on the complexity of the piece and how close the deadline is.These terms and conditions can be adjusted and revised based on the nature of the commission and can be discussed, again through Direct Message on either Twitter or Instagram or through Email.If you do not wish for the commission to be posted on social media, please let me know in advance.
